ACC Architectural and Landscaping Changes Request Form

A main goal of the Pinecliff Homeowners’ Association Architectural Control Committee is to preserve the pristine nature, quality, and beauty of our neighborhood and value of our homes. Common covenant violations go against this goal and will be addressed. Even though membership in the PHOA is voluntary, homeowner compliance to the legally enforceable covenants is mandatory.

General Homeowner Responsibilities include:

Rental homes. Owners are to ensure all individual residents and tenants adhere to the covenants. Rental homes are the biggest source of covenant violations.

Outside improvements/repairs. If you plan on painting, outside remodeling, landscaping, fencing, building, or replacing something on the outside of your property, you need to submit a ACC change request form with written plan with appropriate details and drawings for ACC approval. See below for details. The approved plan is filed to protect the neighborhood and the homeowner if a complaint is filed in the future.   Quick approval/feedback is our goal.

Vehicle parking/recreational vehicle storage. Overnight parking on the street of vehicles leased, owned, controlled by, or used by homeowners or tenants is not allowed. Store recreational/commercial vehicles, boats, or trailers outside of Pinecliff, or within a garage, or within an ACC approved fully screened area. Storing recreational/utility/camping trailers or boats anywhere on lots including driveways is a violation and a source of many complaints.

Roof replacement. All roofing materials must be highly fire, wind, and hail resistant composite, tile, slate, metal, concrete fiber, or asphalt/fiberglass. As a guide, asphalt composite roofs with a minimum weight of 350 to 375 pounds per square, having multiple layers with a shadowing effect, are allowed in filings that do not prohibit asphalt roofs or in filings that have amended covenants that previously prohibited asphalt roofs. With the latest technology, many improved materials have been approved in Pinecliff that have greatly enhanced home appearance and values.

Lot condition/ Landscaping. Homeowners are responsible to keep their lot and house in good condition including house materials and paint/stain, maintenance of lawns, shrubs, trees, and/or landscaping materials. Lawns that are dying or dead, full of weeds, or neglected need attention. Consider xeriscaping, if necessary. Neglecting a lawn is not xeriscaping. Homeowners need ACC approval to re-landscape. Again, rental homes have the most common landscaping/lot maintenance violations.

Conducting a business within Pinecliff. Working from home is common and should not be any different than staying at home. However, when conducting a business, profession, or activity for gain on or within any lot or building site and is noticeable with increased traffic, congestion, activity that causes parking issues or any annoyance/nuisance to the neighbors, then this type of business is prohibited by legal covenants and city code. No lot shall be used except for single family, private residential purposes. No manufacturing or commercial enterprises shall be conducted or maintained upon or in connection with any residential lot. No commercial type (or extra vehicles needed for the business), and no trucks shall be stored or parked on any lot except in a closed garage, nor parked on any street or residential lot.

Specific Requirements for ACC CHANGE REQUEST FORM for outside projects:

Submit a detailed materials description and a plan and drawing showing structural changes, fence lines, landscaping details (e.g., concrete, stonework, trees, scrubs, boundaries etc.). Submit exact changes on a proportioned drawing to include the shape and relative locations of the house, landscaping, fence, lot boundaries and easements on a lot plan/plat with setbacks.

Drawing on an Improvement Location Certificate (ILC) or a legal survey plot is preferred. Exterior Painting: Submit color samples for any paint change (These are not required if repainting with the same, previously approved color; simply state the color name). Roofing: Submit detailed specifications for new roofing including the name, material type, color, fire/wind/impact ratings and weight per square for composites. If the roofing material is a new product, please submit a brochure/web site and a manufacturer’s contact phone number.
